The Carmack Amendment to the original Interstate Commerce Act states that Carrier's are liable for the "Actual loss or injury to the property". What this provision does not state is how does a company prove Carrier negligence beyond a doubt. With that being said, many companies do not have the technical expertise to properly evaluate transportation damages and file claims for recovery of those claims in a timely fashion. Since this time consuming and complicated task is often neglected, the net result is a loss of millions of dollars annually creating a negative impact on a company's bottom line.
